Yamanashi Industrial Location Contingent Fee System
■ Summary of the system
It is the system which the remuneration is paid for providing effective information regarding firm location in order to promote industrial location to Yamanashi by collecting new location and investment plans in its early stages and use for promotion.
■ Target site
Land of group more than 2,000 square meters in the district which the governor appoints is the object.
(1) Suitable site for factory by Factory Location Act
(2) Industry inducement zone by Act for Inducement of Industry to Rural Areas
(3) Area which firm location should be promoted intensively by Firm Location Promotion Law
(4) Area which prefectural or municipal government promotes the firm location.
■Target industries
Of the following industries, it is for locating companies from outside of Yamanashi shall be qualified. (In some cases, type of business may be limited depending on the industrial park.)
(1) IT related industry
Electronic parts and devices manufacturing, Information services, etc
(2) Bioindustry
Medicinal chemical manufacturing, food manufacturing, etc; using biotechnologies
(3) Other industry
Manufacturing, Cargo distributor, Warehousing, Packaging and wholesale industries, etc
■ Eligible information provider
Eligible information provider shall be limited to corporations who run the following business. (Individuals acceptable in the case of (3))
(1) Construction (2) Architect (3) Real estate profession (4) Bank (5) Trading company
Note, however, that the following person cannot provide information.
(1) Under business suspension
(2) A member of an organized crime group
(3) Other people who the governor disqualifies.
■ Outline of procedures
・ With the consent of the firm planning location, submit a designated information provision form to the handling department of the prefectural government.
・ The prefectural government shall issue a receipt upon completion of a hearing with the concerned municipality and conducting necessary examinations.
・ The contingent fees shall be considered for payment when the firm location is ensured within three years, in principle, of the receipt date.
(“the firm location is ensured” = Development is completed. Also the land sale contract or the lease contract is exchanged.)
■ Attention point
In the following cases, a receipt shall not be issued for submission of an information provision form.
(1) When it is the information that the prefectural government has already grasped
(2) When it is the information concerning a firm in Yamanashi.
(3) When negotiation on the desired location is already in progress with other firm
(4) When the company planning a location provides information.
(5) Other cases, when it is considered to be inappropriate under the land-use plan.
■ Amount of contingent fee
Contingent fee shall be 3% of the land sale amount in case of sales and be the amount equivalent to the one month rent in case of lease. The upper limit shall be 100 million yen.
